Screen and Scitex come to pre-trial settlement of patent dispute

Dainippon Screen Mfg. Co., Ltd., (headquarters: Kyoto Japan; president: Akira Ishida), Scitex Corporation Ltd., Harlequin Ltd., Harlequin Inc., Island Graphics Corporation and DK&A, Inc. announced today that they have agreed to a pre-trial settlement of their disputes relating to Scitex's U.S. Patent Nos. 5,113,249, 5,323,248, 5,420,702 and 5,481,379 and Screen's U.S. Patent Nos. 5,249,067 and 4,992,864. The patents relate to trapping, color correction and halftone dot generation technology used in prepress and color page editing and production.

In an action filed in the United States District Court in San Francisco in late 1996, Screen sought a declaration of patent non-infringement and invalidity of the Scitex patents and Scitex's infringement of the Screen patents, while Scitex sought a declaration of patent non-infringement and invalidity of the Screen patents and the plaintiffs' infringement of the Scitex patents. Each side defended the claims made against it and agreed to settlement without admission as to the validity, enforceability or claim coverage of the other side's patents. Under the parties' settlement, cross-licenses have been granted under the above-identified patents in the suit so that the parties and their sublicensee suppliers, OEMs and end users are protected against claims of patent infringement under those patents.
